Can you get divorced in Curaçao with a Dutch marriage?
The answer is: yes. Even if your marriage was entered into in the Netherlands, you can apply for a divorce at the Court of First Instance in Curaçao. The condition is that there must be a clear connection with Curaçao, for example because you or your partner lives here.
Because Curaçao is part of the Kingdom of the Netherlands, a divorce granted here is recognised in the Netherlands. This means that after the ruling and registration with the civil registry (Kranshi), you are officially divorced in both Curaçao and the Netherlands.
Which rules apply?
In most cases, Curaçao law applies, but there may also be connecting factors with Dutch law, especially if both partners have Dutch nationality. This is assessed on a case-by-case basis.

The procedure
A divorce is initiated by filing a petition with the Court of First Instance. This can be done jointly or unilaterally. After the judge grants the divorce in a court order, it is registered in Kranshi's records. Only then is the divorce official.
